The legal arguments defendant raises regarding her status as "media," application of retraction statutes, privilege, actual malice, and Padrick's status as a public figure may be addressed in defendant's trial memorandum, due on November 22, 2011 (limited to ten pages per Jury Trial Management Order, dkt # 39 . Defendant is urged to re-read the November 15, 2011 Scheduling Order setting plaintiff's motion to compel for argument on November 28, 2011. At this point, the Court has not ordered defendant to produce to plaintiffs documents responsive to plaintiff's requests for production 1, 3, 5, 6, and 8, and has not ordered defendant to provide to plaintiffs a response to plaintiffs' interrogatory number 3. The Court has only set a hearing on plaintiffs' motion to compel and ordered defendant to bring the responsive documents and interrogatory response with her to the hearing at which time the Court will hear argument from plaintiffs and defendant on whether defendant will be ordered to produce the documents and the interrogatory response to plaintiffs. The Court construes defendant's argument regarding a "conflict of interest" form as a motion to reconsider the Court's previous Order denying her request (dkt # 20 ). The Court denies the reconsideration motion for the reasons stated in the previous Order. The Court construes defendant's argument regarding the award of attorney's fees to plaintiffs' for defendant's failure to appear at a properly noticed deposition, as a motion to reconsider the Court's previous Order allowing such fees (dkt # 57 ). The Court denies the reconsideration motion. The Court construes defendant's argument regarding the "Anti-SLAPP" statutes as a motion to reconsider the Court's previous Order finding that defendant had failed to timely file a motion pursuant to O.R.S. 31.150 (dkt # 26 , page 15). The Court denies the reconsideration request. The Court construes defendant's argument that plaintiffs' claim should be dismissed because the December 25, 2010 blog post which is the subject of the trial in this case was not specifically cited in plaintiffs' Complaint, as a motion to reconsider the Court's Order denying defendant's motion for a more defendant statement (dkt # 22 ). The Court denies the reconsideration motion for the reasons stated in the previous Order. Ordered by Judge Marco A. Hernandez. Copy of order emailed to defendant. (mr) (Entered: 11/16/2011)

The court denies the following defenses as stated in defendant's Trial Memorandum: Defenses under (1) the Oregon retraction statute; (2) Anti-Slapp law; (3) actual malice; and, (4)absolute privilege. The court determines that the plaintiffs are not public figures, that defendant is not the media, and that the shield law doesnt apply. Additionally, the court determines that the subject matter of the blog post at issue is not a matter of public concern. An opinion explaining the courts reasoning on these issues will follow. Plaintiffs' exhibits 4-20A and 27-27A from obsidianfinancesucks.com website are excluded unless defendant testifies. 2011-11-30 95 0 Opinion OPINION: Based on the evidence presented at the time of trial, I conclude that plaintiffs are not public figures, defendant is not "media," and the statements at issue were not made on an issue of public concern. Thus, there are no First Amendment implications. Defendant's other defenses of absolute privilege, Oregon's Shield Law, Oregon's Anti-SLAPP statute, and Oregon's retraction statutes, are not applicable. See 13-page opinion attached. 2013-04-11 167 0 Order on motion/application for leave to proceed ifp ORDER: Defendant's Application for Leave to Proceed IFP 156 is DENIED as moot because no filing fees are required as a defendant, even when asserting counterclaims, and thus there is no need for defendant to proceed IFP in this Court. Defendant's Motion for Leave to File "Amended Counter Complaint" 160 is construed as a motion for leave to file an amended answer asserting new counterclaims and is DENIED. The Notice of Appeal filed in this case deprives this Court of jurisdiction over any matters related to the appeal. Griggs v. Provident Consumer Disc. Co., 459 U.S. 56, 58 (1982). Amending an Answer to assert new counterclaims or to add new counter-defendants relates to the merits of this case which is on appeal. As a result, this Court has no jurisdiction to allow amendments of the pleadings. Defendant's Motion to "Legally Relate District of Nevada RICO Complaint" 158 is DENIED as baseless. Defendant's Application for CM/ECF Registration as a Self-Represented Party 155 is DENIED. Ordered by Judge Marco A. Hernandez. (mr) (Entered: 04/11/2013)
